Terms of Service

  1. "Rankmind" refers to the applications, platform, web site and services controlled, operated or produced by Rankmind, Inc.. "We" (or "us") means Rankmind, Inc. and the operating team behind Rankmind. "You" or “User” means any person or organization accessing Rankmind. "Candidate" means any person that logs into Rankmind to take a test to benefit you.
  2. You agree to be bound by the terms and conditions set forth in this document.
  3. You may not modify, adapt, translate, or reverse engineer any portion of Rankmind, or use any robot, spider, site search/retrieval application, or other device to retrieve or index any portion of Rankmind.
  4. You agree not to take any action that imposes or may impose (in Rankmind’s sole discretion) an unreasonable or disproportionately large load on Rankmind’s infrastructure.
  5. You may not use Rankmind in any manner that could damage, disable or impair its services.
  6. You are not allowed to bypass robot exclusion headers or other measures Rankmind may use to prevent unauthorized access to the Rankmind Service.
  7. You may not reformat, frame, resell or abuse any portion of Rankmind.
  8. You may use paid Rankmind services only for the benefit of the purchaser of the service and only in one country. No sharing of one subscription between branches in different countries and no reselling are allowed.
  9. You may not remove, circumvent, disable, damage or otherwise interfere with security-related features of Rankmind Service or Uploader Submissions, features that prevent or restrict use or copying of any content accessible through Rankmind Service, or features that enforce limitations on the use of Rankmind Service or Uploader Submissions.
  10. You may not use Rankmind unless you take all necessary steps to transfer to us all rights to all content (including, but not limited to, testcases and source code) entered into Rankmind by you and Candidates. If any content entered by Candidates into Rankmind is subject to copyright, patent law or any other intellectual property law, you are responsible for the arrangement of the rights transfer with Candidates.
  11. You may not use Rankmind for any illegal or unauthorized purpose. You are solely responsible for your conduct and any data that you or Candidates deposit in Rankmind. In particular, if you choose to use Rankmind to store Candidates' personal information and if you or Candidates are located in jurisdiction that requires Candidates' consent to store their personal information, you shall obtain the prospective Candidates' consent before issuing passcode to them.
  12. You agree not to make unsolicited offers, advertisements, proposals, or send junk mail or spam to other Users of Rankmind. This includes, but is not limited to, unsolicited advertising, promotional materials, or other solicitation material, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, and petitions for signatures;
  13. You are solely responsible for any claims that anybody may have due to the fact that you use Rankmind.
  14. You are solely responsible for any decisions you make based on the information obtained from Rankmind.
  15. You acknowledge that testing is a statistical process with inherent randomness and that the result of any particular test may not accurately reflect the reality.
  16. We reserve the right to disable (some or all of) the functionalities of Rankmind for any account at any time, without notice, without liability to you or any third party.
  17. When you use the products, services, or information from Rankmind, you may be asked to provide a password. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You agree that the information you provide to Rankmind on registration and at all other times will be true, accurate, current, and complete. You also agree that you will ensure that this information is kept accurate and up-to-date at all times. If at any time you have reason to believe that your account is no longer secure (e.g., in the event of a loss, theft or unauthorized disclosure or use of your account ID, password, or any credit, debit or charge card number, if applicable), then you agree to immediately notify Rankmind. You may be liable for the losses incurred by Rankmind or others due to any unauthorized use of your Rankmind account.
  18. If you have comments on Rankmind, or ideas on how to improve it, please contact us. Please note that by doing so, you also grant us the right to use and incorporate your ideas or comments into Rankmind without further compensation. If you do not agree to this policy, then please do not send us your ideas, comments and suggestions, by email or otherwise.
  19. You grant Rankmind the right to use your company name and location in marketing materials and other public documents issued by Rankmind, upon pre-approval of the format and content.
  20. Rankmind IS PROVIDED “AS IS,” WITH NO WARRANTIES WHATSOEVER. Rankmind DISCLAIMS ANY WARRANTIES REGARDING THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THE SERVICE.
  21. UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE TO ANYBODY ON ACCOUNT OF YOUR USE OR MISUSE OF Rankmind. SUCH LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SUCH LIMITATION OF LIABILITY SHALL APPLY WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF AND RELIANCE ON Rankmind, FROM INABILITY TO USE Rankmind, OR FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF YODACODE SERVICE (INCLUDING SUCH DAMAGES INCURRED BY THIRD PARTIES). SUCH LIMITATION SHALL APPLY NOTWITHSTANDING A FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW. YOUR ONLY RIGHT WITH RESPECT TO ANY DISSATISFACTION WITH Rankmind SHALL BE TO TERMINATE USE OF Rankmind. Some countries do not allow the exclusion or limitation of damages in which case any liability for damages and cost shall be limited to US$100.00.
